Zakat and deducting future bills

Question

A person’s yearly Zakat date fell on April 17 this year. In regards to his business assets:

  1. Can he deduct as a current liability his shop rent for the month of May which is due on May 1st from his assets?
  2. If a person has a lease, is there a view that you can deduct up to 1-year rental lease expense as a valid liability?

Answer

A person will only deduct liabilities that are due on his Zakat anniversary based on the lunar calendar, not the liabilities that arise thereafter. Therefore, the shop rent for May will not be deducted. The same applies to the rent for the forthcoming year, unless one is contractually liable on the Zakat anniversary to pay for the full year albeit in instalments.

Does Diabetes Prick Test break ablution?

Question

If someone has a diabetes prick test regularly, does the ablution break? It is just a small dot on the finger which is wiped off.

بسم الله الرحمن الرحیم

Answer

Flowing blood nullifies ablution. Therefore, if after the prick (and squeezing the finger if applicable), the blood is not wiped away and it flows, then this would indicate that it is flowing blood. However, if the blood does not flow, this would indicate that it is not flowing blood, and therefore the ablution would not break. If unsure, err on the side of caution and perform ablution.

قال محمد في الأصل (١/٥٧): قلت: أرأيت رجلا به دمل أو قرحة فخرج منه دم أو قيح أو صديد فسال عن رأس الجرح؟ قال: عليه أن يعيد الوضوء. قلت: فإن كان قليلا لم يسل عن رأس الجرح؟ قال: فلا وضوء عليه. وقال (١/٥٨): قلت: أرأيت رجلا به جرح وكزه فخرج منه دم قليل فمسحه ثم خرج منه أيضا فمسحه وذلك كله قبل أن يسيل؟ قال: إن كان الدم لو ترك ما مسح منه سال أعاد الوضوء، وإن كان لو ترك لم يسل لم ينقض وضوءه. وقال (١/٦٤): قلت: أرأيت رجلا توضأ ثم رعف وهو قليل لا يسيل؟ قال: لا ينقض وضوءه، انتهى. وقال السمرقندي في تحفة الفقهاء (١/١٨): فما لم يسل عن رأس الجرح لا يصير خارجا، انتهى. وقال السرخسي في المبسوط (١/١٠٧): وفي العبادات يؤخذ بالاحتياط، انتهى۔

No alternative Halal medicine on the NHS

Question

Sometimes patients get prescribed Ḥarām medicine on the NHS and there is no Halal alternative on the NHS. However, it is possible to purchase a Halal alternative or obtain a private prescription for the Halal alternative. In this scenario, is it necessary to pay for the Halal alternative?

Answer

The default position is that medication via unlawful products is prohibited, unless there is no alternative and a competent Muslim medical professional advises that the medicine is the cure for it. If a Halal alternative is available without a prescription or via a private prescription and one can afford it, then the Ḥarām medicine must be avoided. Many people wrongly assume that if the Halal alternative is not available for free, then the Ḥarām option automatically becomes permissible. This is not correct.

قال فخر الإسلام البزدوي: فعل الاستشفاء بالحرام إنما لا يجوز إذا لم يعلم أن فيه شفاء، أما إذا علم أن فيه شفاء وليس له دواء آخر غيره يجوز الاستشفاء به، كذا في البناية (١٢/٢٧١). وقال ابن مازه في الذخيرة البرهانية (٧/٣٦١): قال الصدر الشهيد رحمه الله: وفيه نظر، لأن لبن الأتان حرام، والاستشفاء بالحرام حرام. وما قاله الصدر الشهيد فهو غير مجرى على إطلاقه، فإن الاستشفاء بالمحرم إنما لا يجوز إذا لم يعلم أن فيه شفاء وليس له دواء غيره، انتهى. وحكاه السِّغناقي في النهاية وعنه الزيلعي في تبيين الحقائق (٦/٤٩). وقال الزيلعي في تبيين الحقائق (٦/٣٣): قال في النهاية: يجوز التداوي بالمحرم كالخمر والبول إذا أخبره طبيب مسلم أن فيه شفاء، ولم يجد غيره من المباح ما يقوم مقامه. وقال البابرتي في العناية (١٠/٦٧): فإن علم أن فيه شفاء وليس له دواء آخر غيره يجوز له الاستشفاء به، انتهى. وقال الحصكفي في الدر المختار (١/٢١٠): وقيل: يرخص إذا علم فيه الشفاء ولم يعلم دواء آخر كما رخص الخمر للعطشان، وعليه الفتوى، انتهى. وراجع رد المحتار (٥/٢٢٨)۔
